Activity (or ‘activities’): means the provision of the escape room activities to be provided by the Company in accordance with these Terms and Conditions and the Rules of the Room.
Booking: means when a booking is made via the Company website and the full amount due for the Activity is paid.
Charges: means the charges (price) to be paid by the Customer as detailed on the Company website www.escape-halse.com
The Company (or ‘we’, ‘us’, ‘our’): “Escape-Halse” a provider of escape room entertainment based at Halse Mission, Halse, Brackley NN13 6DY (the ‘Venue’). This includes where applicable, its employees, suppliers and subcontractors acting on behalf of the Company.
The Customer (or ‘you’, ‘your’, ‘participant’, ‘they’): means a party (including each individual member of that party) that has made a Booking and has received a booking confirmation.
Group Booking: means a Booking made, with the consent of all members of the party having been obtained prior to making a Booking. The person who completes the online booking will be the lead name and must be 16 years of age or over at the time of booking. The lead name is responsible for the total booking price and takes responsibility for honouring these Terms and Conditions.
Terms and Conditions: means these Terms and Conditions.
The Rules of the Room: means the rules that apply when participating in the Activity.
Waiver: means the Liability Waiver and Media Release provided to you prior to partaking in the Activity.
Interpretation
Headings do not affect the interpretation of these Terms and Conditions. References to Clauses and Schedules are to the clauses and schedules of these Terms and Conditions.
A Booking is complete when you have paid the cost in full and you receive your booking confirmation.
You must ensure all details are correct at the time of making your Booking. If any details are incorrect on your confirmation email, you must contact us immediately to make any necessary changes.
For Group Bookings, the consent of all members is required and all members must read and agree to these Terms and Conditions. The individual making the Booking online will be the lead name for the purposes of booking. The lead name must be 16 years of age or over at the time of the Booking and will be responsible for the payment of the total amount due.
For Group Bookings, the number registered to participate in the Activity must not be exceeded on the day of the Booking. Any variations to the Booking must be made in accordance with Clause 5 and may be subject to a further cost.
We reserve the right to reject a Booking and decline or revoke a confirmation email.
Participants under the age of 16 must be accompanied by an adult (above the age of 16). If they are not accompanied by an adult, they will not be permitted to participate in the Activity.
You must inform us, in writing, of any disabilities or medical conditions which may affect the arrangements for that person, prior to making a Booking. We may require you to produce a doctor’s certification certifying fitness to participate. If you do not inform us in advance of your Booking, of any medical conditions or disabilities, and we are unable to accommodate the participant, we reserve the right to cancel your Booking without a refund.
You must arrive 15 minutes before your Booking time to allow for the registration process and review of the Rules of the Room.
If participants arrive late to the Venue, they may be refused entry and the Booking treated as a cancellation and they will not be afforded a refund. If you suffer problems on the day, you should contact us as soon as possible so we are able to let you know the options available.
If you have any special requests, these must be advised either prior to, or at the time of Booking. While we endeavour to meet special requests, we cannot guarantee to be able to accommodate these unless they have been specified in writing at the time of making your Booking. We do not accept any bookings that are conditional upon any special request being met.
On the day of the Activity, you will be presented with a Waiver. By agreeing to this, you acknowledge that you have read the Waiver, these Terms and Conditions and Rules of the Room and understand those rules.
Price and Payment
All prices are in GBP sterling
The full amount due for the Booking must be paid online at the time of making the Booking.
We reserve the right to amend the price of the Activity at any time prior to the completion of a Booking.
Cancellation and Variation
If due to circumstances beyond our control, it is necessary to amend your Booking, we reserve the right to delay, rearrange or cancel your Booking and will endeavour to notify you as soon as possible. In such circumstances, you will be entitled to a full refund or if possible the choice of an alternative booking time.
In the event of a cancellation due to a force majeure event as per but not limited to Clause 8 of these Terms and Conditions, we reserve the right to amend your Booking and you will be entitled to a full refund for the cost of your Booking or the option of an alternative booking time. We are not liable for any compensation claims or travel expenses or any other costs incurred by you as a result.
If you wish to amend any part of your Booking after receipt of your confirmation email, you must inform us in writing as soon as possible, but no later than 14 days prior to the date of your confirmed Booking.
Whilst we will endeavor to accommodate your requests, we cannot guarantee we will be able to meet your requested change. Should we not be able to accommodate your requested change and you do not wish to proceed with your Booking, this will be treated as a cancellation and a fee may be payable.
If you wish to cancel your confirmed Booking, you must notify us in writing at least 14 days prior to the date of your Booking to be entitled to a full refund or for your Booking to be rearranged. No refunds will be given for cancellations outside of this period.
If you wish to rearrange your Booking, you must provide written notice of at least 7 days before the date of your Booking. While we endeavor to accommodate rearranging your Booking where possible, if this is not possible, we reserve the right to cancel your Booking without a refund.
If you request to rearrange your Booking outside this 7 day period, it may be refused and treated as a cancellation.
Bookings made with a gift voucher may be rearranged, but are non-refundable.
We reserve the right to cancel your booking if you or any of your party are under the influence of drugs or alcohol and we deem you unfit to play
If you bring more people to play than have been booked for we reserve the right to not accept them or charge an addtional cost
Liability
We agree to exercise all reasonable skill and care in providing the Activity. Neither we, nor our employees or agents, will be liable for any damage, loss or delay or expense caused to you when attending the Activity or participating in the Activity.
We will not be liable for any injury, illness, death, loss, damage, expense or cost of claim of any nature which results from any act(s) and/or omission(s) of you or another participant of the Booking or the act(s) of a third party not connected with the provision of the Activity which were unforeseeable or unavoidable.
Nothing in these Terms and Conditions will exclude or limit liability for (i) death or personal injury caused by our negligence or the negligence of our employees (ii) for fraud or fraudulent misrepresentation or (iii) for any other liability that cannot be excluded or limited by applicable law.
We have no liability for any of your property stored at the Venue.
We will have no liability for any failure to provide the Activity if this is prevented by a force majeure event as specified in Clause 8, or any related claims for compensation arising from such event.
You agree that in the event of damage being caused to our facilities because of any deliberate, reckless or negligent act or omission (including in breach of the the Rules of the Room, you will be liable for all the damage or for the full amount due for replacement of each item.
You agree to comply with all our health and safety regulations during your attendance at the Activity and you agree that you will not act irresponsibly to endanger yourself, staff and other participants or to cause any risk of injury or damage.
You accept liability for reading and adhering to these Terms and Conditions and the Rules of the Room and each player agrees to the Terms and Conditions and the Rules of the Room of the Activity prior to entering the escape room and partaking in the Activity as well as signing the Waiver.
Data Protection
We will keep any personal data you provide to us secure by using appropriate security and technical measures.
We will comply with all applicable laws, statutes, regulations and codes relating to data protection from time to time in force in the UK including but not limited to the Data Protection Acts 2018 and all implementation, replacement and modifying legislation and regulations.
You agree that we are entitled to take recordings, photos or media recorded for our own marketing, unless otherwise agreed, as well as maintenance of safety during the Activity.
Force Majeure
We will not be liable to perform any of our obligations under these Terms and Conditions if such delay or failure results from events or circumstances outside our reasonable control by way of, but not limited to, adverse weather conditions, utility disruption, fire, natural disasters, industrial disputes, war, riots, civil strike, terrorist activity or any similar events beyond our control.
We will not be liable to pay compensation where the performance of our obligations are not possible due to a force majeure event, as referenced but not limited to Clause 8.1.
General
We will hold and maintain in force, with a reputable insurance company, public liability insurance to cover liabilities that may arise under or in connection with these Terms and Conditions.
If any terms of these Terms and Conditions are found to be invalid or unenforceable, the other terms will remain in full force and effect.
No third party is entitled to enforce any term under these Terms and Conditions under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
Any notice, confirmation or other communication by either the party must be in writing, either by email or by post. Any notice or communication will be deemed to have been received:
If this is sent by pre-paid first class post, at 9am on the second working day after posting;
If this is sent by email, at 9am on the next working day after transmission.
These Terms and Conditions are governed by the law of England and Wales and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
